Rules of the SupremeXP.net web application

 

These rules are binding for all registered users. SupremeXP Enterprise s.r.o., a company with the business ID no.: 092 94 121, registered at the Municipal Court in Prague under file no. C 333974, with the registered office at Národní 973/41, 110 00 Prague 1, Czech Republic, is the operator of the website, as well as the entity responsible for the website content controllable by the website operator.

   I.     GENERAL PROVISIONS

1.1. Users are required to behave respectfully towards their rivals and observe the rules of decent conduct.

1.2. Users must not attempt to breach the security of the server used to operate the SupremeXP.net website, jeopardise its operation or obtain personal data of other users in any manner.

1.3. Users agree to their data entered in their public profile being published.

  II.     CONDITIONS OF REGISTRATION

2.1. Any physical person can register on the SupremeXP.net website register free of charge but only physical persons 15 years old or older can convert the SupremeXP COINS won in tournaments to Czech crowns (CZK).

2.2. During the registration process, each user is required to enter their name and surname, nickname (nick) and a valid e-mail address for delivery of confirmation details required for establishing a user account. 

2.3. When activating their virtual wallet, users are required to provide their residential address, mobile phone number and date of birth.

2.4. When a virtual wallet is activated by a person younger than 15 years, no additional details are required, as these users cannot convert the SupremeXP COINS won in tournaments into Czech crowns (CZK).

2.5. When a virtual wallet is activated by a person aged 15 years or more but younger than 18 years, a mobile phone number of a legal representative must be included with the details indicated in paragraph 3 of this article and the legal representative must confirm this phone number. Users completing their registration are also required to provide their bank account number and/or PayPal connection.

2.6. When a virtual wallet is activated by a person aged 18 years or more, no additional personal data except the details listed in paragraph 3 of this article are required. Users completing their registration are also required to provide their bank account number and/or PayPal connection.

2.7. In addition, users are required to indicate whether they are an entrepreneur in sport (further only a “professional user”) or not.

2.8. By registering on the SupremeXP.net website, users express their agreement with these rules without any reservations.

2.9. By registering on the SupremeXP.net website, users confirm that they have read, understand, agree with and will abide by these rules.

2.10.  Users using a photograph, image or graphics during the registration process or while using the SupremeXP.net website and entering these in their profile or match results are required to do so in compliance with the laws of the Czech Republic, without damaging the reputation of the SupremeXP.net website or its operator and without breaching generally applicable rules of decent conduct. Any breach of these rules and entering any unacceptable visual files may be sanctioned by the website operator by cancelling the relevant profile or exercising personal and proprietary rights in the case of their breach. 

2.11.  By placing and publishing a profile photograph, photograph, image or graphics concerning the outcome of a match, users provide their declaration to the operator of the SupremeXP.net website that copyright or other rights or justified interests of third parties (such as the right to the protection of personality of physical persons) will not be jeopardised or breached and that generally binding legal regulations or generally applicable ethical rules will not be violated. Users hereby acknowledge that if the third-party rights referred to above are exercised in relation to the operator of the SupremeXP.net website, the relevant user assumes in full their responsibility arising for them in these cases directly in relation to third parties or subsequently after the operator of the SupremeXP.net website exercises a third-party claim retrospectively in relation to the relevant user.

2.12.  User profiles are not transferrable.

   III.     DISCUSSION RULES

3.1. Posts published in discussion by users or other persons express their own opinions. The operator of the SupremeXP.net website will not bear any liability for such posts. 

3.2. Users acknowledge that publishing any visual and/or audio statements constituting advertisement, and sending spam, vulgar, racist or other offensive statements is prohibited.

3.3. The operator of the SupremeXP.net website reserves the right to remove any posts that would give rise to suspicion of a breach of the rules referred to above. This is without prejudice to the user’s liability for any damage arising from such incident. 

  IV.     TOURNAMENT RULES OF CONDUCT

4.1. Users of and visitors to the online tournaments of the SupremeXP.net website acknowledge that playing these tournaments does not require merely skill or physical exercise pursuant to the provisions of Act No. 89/2012, Civil Code, as amended, and the provisions of Section 2873 et seq. on betting will also apply.

4.2. Users acknowledge that any form of cheating is prohibited in all tournaments. 

4.3. Cheating means manipulating files and using scripts or other SW programs to benefit the user alone or the user’s team to the detriment of their rivals. 

4.4. If cheating is confirmed, the user/team faces the risk of being excluded from the tournament in progress and being banned from starting in subsequent tournaments.

4.5. Access to tournaments is free of charge or for a fee payable in virtual SupremeXP COINS, depending on the rules of specific tournaments.

V.     USER IDENTIFICATION

5.1. Nicknames (nicks) are a voluntary choice of individual users and the operator of the SupremeXP.net website bears no liability for their content. These rules prohibit the use of any nicks that:

  1. Are subject to protection under third-party rights, if the user does not have a written consent with their use;
  2. Resemble brands or trademarks, regardless of these being registered or not;
  3. Imitate and/or mock nicks of other users.

5.2. Any offensive or vulgar nicks or nicks that promote racial or ethnic animosity or are in conflict with ethical rules or the laws of the Czech Republic are prohibited. The same conditions apply to team names.

  VI.     TOURNAMENT RULES

6.1. Each tournament is subject to precisely defined specific rules determined by the organiser of the tournament prior to start. 

6.2. By registering for a tournament, users express their agreement with the specified tournament rules and are required to abide by these rules for the entire duration of the tournament. 

6.3. The organiser is entitled to change tournament rules in particular in situations when this change would improve the quality of the course of the tournament. The organiser is obliged to notify all participating users of this change immediately after its implementation.

 VII.     PRICES, VIRTUAL WALLET

7.1. If a user achieves an awarded place in a tournament (usually the 1st, 2nd, 3rd and 4th place), the specified number of SupremeXP COINS, the so-called Supreme COINS, will be credited to their virtual wallet according to the place achieved in the relevant competition and the rules of the specific tournament announced by the operator of the SupremeXP.net website prior to the start of the tournament.

7.2. All users may activate their virtual wallets to keep and manage their SupremeXP COINS.

7.3. SupremeXP COINS achieved by users aged fifteen years or older, who have an activated virtual wallet, will be automatically converted to Czech crowns (CZK) after being credited to the virtual wallet. These credits are converted to Czech crowns (CZK) at the rate of 10 /1.

7.4. Users younger than fifteen years can exchange the SupremeXP COINS won up to the day of their fifteenth birthday for credits identical to the credits mentioned above after turning fifteen and after adding a telephone number of their legal representative. The relevant legal representative must confirm their phone number and provide a bank account number and/or PayPal connection.

7.5. Users can have their winnings paid out in Czech crowns (CZK) by the operator of the SupremeXP.net website at any time and at their discretion at the rate of ten SupremeXP COINS in the virtual wallet to one Czech crown (CZK). This means that a user receives one Czech crown for each ten SupremeXP COINS.

7.6. In view of the current wording of the tax regulations, distinguishing between professional users and other users is essential.

7.7. Users who are professional users and declare this information in a due manner during the registration process in accordance with Art. II of these rules can have their winnings paid out by the operator of the SupremeXP.net website in Czech crowns upon their request at the ratio of 10/1 according to the number of SupremeXP COINS in their virtual wallet . This means that they receive one Czech crown for each ten credits.

7.8. Users who are not professional users and declare this information in a due manner during the registration process in accordance with Art. II of these rules can have their winnings paid out by the operator of the SupremeXP.net website in Czech crowns upon their request at the ratio of 10/1 according to the number of SupremeXP COINS in their virtual wallet . This means that they receive one Czech crown for each ten SupremeXP COINS. This amount will be subject to tax according to the currently valid tax regulations.

7.9. The prizes announced by the operator of the SupremeXP.net website prior to any tournament cannot be claimed in court.

7.10.  Users/teams breaching any of the provisions of these rules will not be entitled to winnings even if they are successful in the game.

7.11.  To collect their winnings, users are required to provide their bank account number or PayPal connection for sending potential winnings during the registration process. If a user fails to provide their bank account number and/or PayPal connection will forfeit their entitlement to their winnings.

7.12.  Persons employed by the organiser of the competition, persons in a similar relationship with the organiser of the competition or their close relatives or friends (provisions of Section 22 of Act No. 89/2012 Coll., Civil Code) or persons cooperating within the competition directly or indirectly are excluded from participating in the competitions.

VIII.     RULES FOR PROGRAMS ON THE SUPREMEXP.NET WEBSITE

8.1. Any interviews with guests of the SupremeXP.net website conducted during recording of programs on the SupremeXP.net website express the authentic opinions of these guests and the operator of the SupremeXP.net website will not bear any liability for the course of these interviews. 

8.2. The operator of the SupremeXP.net website does not put guests under any pressure during recording.

8.3. Programs may not be provided to third parties or further modified without consent of the operator of the SupremeXP.net website. Programs are subject to copyright held by the operator of the SupremeXP.net website.

   IX.     SUPREMEXP.NET OFFLINE EVENT

9.1. The operator of the SupremeXP.net website will not bear any liability for any loss of assets, conduct or opinions of visitors to SupremeXP.net offline event.

9.2. Users and visitors to offline events of the SupremeXP.net website acknowledge that games operated at these events do not require skills pursuant to the provisions of Section 2881 of the Civil Code. Any claims concerning prizes (in the form of gifts or finance) from any offline events therefore cannot be exercised in court. 

X.     RULES FOR UPLOADING OTHER AUDIOVISUAL MATERIALS

10.1.  Users are entitled to publish their own photographs, videos or other audio-visual materials under their profiles. Users acknowledge that in this case the publication of audio-visual materials will not violate the valid laws of the Czech Republic, damage the reputation of the SupremeXP.net website or its operator or breach generally applicable ethical rules. Any breach of these rules and publishing unacceptable visual files may be sanctioned by the website operator by cancelling the relevant profile or exercising personal and proprietary rights, if these are violated. 

10.2.  By publishing audio-visual materials on the SupremeXP.net website, users provide declaration to the operator of the SupremeXP.net website that copyright or other rights or justified interests of third parties (such as the right to the protection of personality of physical persons) will not be jeopardised or breached and that generally binding legal regulations or generally applicable ethical rules will not be violated. Users hereby acknowledge that if the third-party rights referred to above are exercised in relation to the operator of the SupremeXP.net website, the relevant user assumes in full their responsibility arising for them in these cases directly in relation to third parties or subsequently after the operator of the SupremeXP.net website exercises a third-party claim retrospectively in relation to the relevant user.

   XI.     OTHER RULES

11.1.  Any passwords and information from gaming accounts are stored in an encrypted form to prevent any attacks by third parties. 

11.2.  Any personal data provided by users are only used for the purposes of the SupremeXP.net website and will not be disclosed to third parties.

11.3.  The operator of the SupremeXP.net website will not be liable for any actions or conduct of users on the SupremeXP.net website and at offline events organised by the website or the operator of the SupremeXP.net website or for any content uploaded to the website by the users (including text, graphics, audio and video recordings).

11.4.  The operator of the SupremeXP.net website is entitled to record the course of and individual moments in the ongoing tournaments at its discretion and use these recordings for any purpose. Users declare that they do not hold any copyright or rights of a different nature in relation to the nature and course of the tournaments.

11.5.  These rules and all activities within the SupremeXP.net eSport, Cinema and real-life fun network are governed by the laws of the Czech Republic.
